This website is provided as a service by $69 Chiro CE, which is a company that is owned, operated, and protected by Online CE, LLC. This page sets forth the Terms and Conditions governing your use of the Site and the Service. Because these Terms and Conditions contain legal obligations (including limitations on liability and arbitration provisions), please read them carefully.

PURPOSE AND ACCEPTANCE OF TERMS

(a) Our Purpose $69 Chiro CE is a company that offers online continuing education courses to people of various professions. The information you find in our seminars or on our site is just that: it is information. We make seminars with great information for you to use in your thought processes as you decide how to carry out your job. We do not make decisions for you. For example, we have a seminar on nutrition for chiropractors, and in that seminar we discuss methylation and which over-the-counter drugs will interfere with methylation, and which nutrients will enhance it. It is your responsibility to use critical thinking and determine if the information is appropriate for your patients. Should you ask them to stop taking certain over-the-counter medications? Should you ask them to take or abstain from certain supplements? Every case is different, and we do not (and will not) advise you on how your care plans should be designed-we can't, because we are not the doctor of the patient. We do, however, offer some suggestions for designing your own care plans for each of your individual patients, but that is all we do.

(b) Acceptance By using this site you agree to be bound by these Terms and Conditions and the Privacy Policy, which is incorporated herein by reference. The Terms and Conditions are not negotiable, but they are fair, realistic and customary.

(c) Modification of Terms We reserve the right, in our sole discretion, to change these Terms and Conditions at any time without notice. In the event we make material changes to the Terms and Conditions, notice of these changes will be posted on the Terms and Conditions page and the revised agreement will take effect thirty (30) days after their publication on this site. It is your responsibility to check periodically for any changes we may make to these Terms and Conditions. Your continued use of this website following the posting of changes to this agreement or other policies means you accept the changes.

WHAT WE DO AND DO NOT OFFER YOU

(a) What We Do We offer online continuing education courses for people of various professions. In most states, the governing body does not want us to send them your certificate, but rather they want you to do that. Often this is because most states audit random Doctors, and they do not want to be flooded with arbitrary certificates. In the event that your state will accept a certificate directly from us, we notify the pertinent governing bodies within 10 business days after you have successfully completed a course. You get your certificate by download button, and you get it immediatley. If you must have a certificate for a second state, then simply email us at CustomerCare@69DollarChiroCE.com and tell us which state you need the certificate for, as well as the license number for that second state, so we can make you a pertinent certificate for the second state.

(b) What We Do Not Do We do not keep track of how many credits an individual has earned or needs to earn. We do not answer questions for the governing bodies, as they are subject to change and we do not wish to provide inaccurate information.

YOUR USE OF OUR SITE

(a) Intellectual Property This website and all of its content including, but not limited to, articles, other text, photographs, illustrations, graphics, product names, designs, logos, video material, audio clips, (collectively, "the Intellectual Property") are protected by copyright, trademark and other laws of the United States, as well as international conventions and the laws of other countries. The Intellectual Property is owned or controlled by $69 Chiro CE or the party credited as the provider or owner of the Intellectual Property. The compilation (meaning the collection, arrangement and assembly) of all content on this Site is the exclusive property of $69 Chiro CE and protected by U.S. and international copyright laws. All software used on this Site is the property of commercial software suppliers, and is protected by U.S. and international copyright laws. The copying, redistribution, use or publication by you of any such matters or any part of the Site, except as allowed herein, is strictly prohibited.

$69 Chiro CE grants eligible users a limited, revocable, nonexclusive license to access the Site for their own non-commercial personal use and in no way do these Terms and Conditions transfer any right, title, or interest in the Site or its content to you, and $69 Chiro CE retains all of their rights, title and interest to the Site and its content. Except as expressly provided herein, nothing contained in these Terms and Conditions shall be construed as conferring, by implication, estoppel or otherwise, any license or right to use the content under any copyright, patent, trademark or other intellectual property right. No other use of the Site is permitted. Permission to reprint or electronically reproduce any document or graphic in whole or in part for any other purpose is expressly prohibited, unless prior written consent is obtained from the respective copyright holder(s). Furthermore, users may not sell, resell, modify, reverse engineer, decompile, disassemble, frame or create derivative works of or otherwise exploit for any commercial purpose the Site or any portion thereof without our prior written consent in each instance. The exception to this rule is that you are allowed, and encouraged, to print the material for personal reference, including teaching your patrons. You simply may not sell the information as your own.

PROHIBITED CONDUCT

As a condition of your use of the website, you agree to act responsibly in a manner demonstrating the exercise of good judgment. For example and without limitation, you agree not to:

(a) violate any applicable law or regulation or use the service for any illegal purposes;

(g) allow any other person to impersonate you or any other entity (you must contact us and the governing body to which they are accountable to obtain continuing education credits);

(h) remove any copyright, trademark or other proprietary right notices contained in the Service;

(i) modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or our Site or any software used on or for the Service; or

(j) assist any third party in doing any of the foregoing.

$69 Chiro CE reserves the right to access any account at any time for any reason or for no reason at all. We also reserve the right to forward any and all personal information to anyone we deem appropriate, such as governing bodies that are accountable to receive your online continuing education information. By agreeing to this contract, you automatically acknowledge and accept that we have access to your account for any reason or for no reason at all and that we will forward any and all information to whom we deem appropriate to protect the interest of $69 Chiro CE, its members and/or third parties.

YOUR ACCOUNT

(a) Your Identity Your account must have your information, and not someone else's information. You may not knowingly allow another person to make an account that has your identifying information. You may not provide any inaccurate, misleading, incomplete or false information or user content to $69 Chiro CE.

(b) Payment Very simply, you pay for any individual course before you enter said course.

(c) Refund Policy Once the Final Exam has been submitted, refunds are not possible.

(b) Your Records We keep your records for a minimum of 7 years. If you need a copy of anything within that timeframe, we are happy to oblige.

DISCLAIMER AND LIMITATION OF WARRANTIES AND LIABILITIES

We are not here to harm anyone, and your information is never distributed in any way, except to your state board on an "as needed" basis, or in cooperation with a subpoena or any other legal requirement. We simply mean to say that we do not sell your information to any third party. You probably don't need any more spam.

Among the legal talk our lawyers would like us to add, we must make it clear that while we have all information stored on 2 separate servers, and backups are taken daily, we do not promise that some grand disaster will not destroy all such information. With backups kept in Dallas, Texas and Seattle, Washington, we believe it would be very unlikely that disaster would strike both areas at the same time, destroying both servers. With that, we suggest you keep a copy of your certificate, but we do not see it as feasible that such disaster would strike to cause total loss of all data. It, frankly, appears that such a thing would be impossible with the 2 servers and daily backups, but then we never expected something as pervasive as Covid19 and the quarantine to happen, either. Still, we'll take good care of you and your privacy and certificates.

Also, while we update our material and knowledge on a regular basis, we cannot guarantee that the latest information that has hit the medical journals has made its way into our courses. The material we have is referenced by reputable sources, and reasonably up-to-date.

We offer you education. We cannot make clinical decisions for you, as so much what goes into a clinical decision is based on the holistic knowledge of the patient, and not generic educational insights. Our material is meant to guide you. Therefore, if you tell your patient that their adrenals are shot because they have dark circles under their eyes, when really they are dehydrated and sleep deprived because they were at an outdoor concert all day yesterday, we are not responsible for your misdiagnosis.

$69 Chiro CE reserves the right to, in its sole discretion and without notice or liability, deny use of the website and/or products to any person for any reason or for no reason at all, including without limitation for any breach or suspected breach of any representation, warranty or covenant contained in this agreement, or of any applicable law or regulation.

You agree to indemnify and hold $69 Chiro CE, its corporate affiliates, directors, officers, employees and agents harmless from any and all claims and demands, including, but not limited to reasonable attorneys' fees made by any third-party due to or arising out of any disruption of the site, site content, or otherwise information or services provided to you by $69 Chiro CE and any breach by you or your affiliates, employees, agents and representatives of these Terms and Conditions and/or applicable law. Again, we offer only education. We cannot make clinical decisions for you, nor legal decisions.

$69 Chiro CE makes no representation that materials in this website are appropriate or available for use in every location, and in fact, they naturally won't be appropriate of available in every location. For example, we may discuss lab tests that are useful for certain things, but such testing may be prohibited in your jurisdiction, even if you have the testing done by a third party. Our focus is on accuracy and breadth of the educational material, and not the ever-changing laws of the various jurisdictions. You must keep yourself informed on the laws that govern you. If you access this website from outside the country of the United States of America, we ask that you not access our site in your country if the nature or contents of our site goes against the laws of your country.

Any user who is a resident of a foreign country agrees that (i) they have voluntary sought and established contact with $69 Chiro CE, (ii) they will not use, transmit, disseminate or upload any material, content, that would violate any applicable local or national laws or regulations of the foreign member's country of residence; (iii) under no circumstance shall $69 Chiro CE be deemed liable under any laws other than those of Las Vegas, Nevada of the United States of America; (iv) his or her participation is governed by the laws of Las Vegas, Nevada of the United States of America and is subject to the arbitration and venue provisions stated herein; and (v) consent to having their data processed in Las Vegas, Nevada or the United States of America.

At current, our seminars are in the English language.

This Agreement shall be governed by the laws of Las Vegas, Nevada of the United States of America without reference to its conflict of laws principles and shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of each is hereby excluded. Any dispute, controversy or other claim arising out of this Agreement shall be resolved by arbitration conducted in English in Las Vegas, Nevada of the United States of America in accordance with their laws and you hereby consent to such exclusive venue and jurisdiction of the the court system of Las Vegas, Nevada of the United States of America. Unless otherwise agreed by the parties, the arbitration panel shall consist of one arbitrator chosen in accordance with the rules and laws of Las Vegas, Nevada of the United States of America. Any such arbitrator shall be knowledgeable in the subject area in which the dispute arises. All discovery shall be completed within forty-five (45) days following the appointment of the arbitrator. Each party shall be entitled to representation by counsel at their own expense, to appear and present written and oral evidence and argument and to cross-examine witnesses presented by the other party, provided that, where appropriate, the arbitrator may receive testimony via telephone, video or other electronic means of communication. The arbitration award shall be in writing and the arbitrator shall provide written reasons for the award. The award of the arbitrator shall be final and binding on the parties hereto and may be enforced in any court of competent jurisdiction. The prevailing party in any action or proceeding to enforce its rights hereunder shall be entitled to recover reasonable attorneys' fees and other reasonable costs, including fees of the arbitrator, incurred in the action or proceedings. For purposes hereof, "prevailing party" is defined as the party whose last settlement proposal prior to hearing in this matter is closest to the final decision. In no event shall the arbiter award punitive or exemplary damages. The parties waive any right they may have to an appeal of the arbitrator's decision and/or award. Each party retains the right to seek judicial assistance: (i) to compel arbitration, (ii) to obtain interim measures of protection prior to or pending arbitration, (iii) to seek injunctive relief in the courts of any jurisdiction as may be necessary and appropriate to protect the unauthorized disclosure of its proprietary or confidential information; (iv) to pursue claims within the jurisdictional limit of the judicial system of Las Vegas, Nevada of the United States of America; or (v) to enforce any decision of the arbitrator, including the final award.

PRIVACY POLICY

This page sets forth Online CE's privacy policies and explains how the information we obtain from you is used when you use or visit our website. Please read this policy carefully since by visiting the Site and/or sharing information with us, you agree to be bound by this Privacy Policy and the Terms and Conditions.

In the event that $69 Chiro CE is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control. Your money is collected by a third party - either PayPal or Authorize.net. Those companies do not share with us very much of your information. On Authorize.net, we are able to see the last 4 digits of your card, the type of card (e.g., Visa, MasterCard, etc), and the name on the card. With PayPal, we only see the name of the account holder. Therefore, your payment information cannot be stolen through any access to our site, at all. This makes us unappealing to hackers, so it is another way you stay safe with us.

This agreement provides that all disputes between you and Online CE, LLC will be resolved by BINDING ARBITRATION.

• You are entitled to a FAIR HEARING. The arbitration procedures are fair, and they are SIMPLER AND LESS COMPLICATED than court proceedings.

To date, after being in service for 10 years, we have never had a grievance in which we could not make the Doctor happy.
